You know the drill: competitions come with rules drafted by lawyers. So forgive us that the following is a bit wordy and written in legalese, but it’s that way so that the rules are laid out and fairly shared with everyone. If you have questions, check out the FAQs where you’ll find lots of answers waiting for you.

International Juried Competition
1. WHO IS ELIGIBLE?
THERE ARE TWO ELIGIBILITY CATEGORIES
The Photography Book Now International Juried Competition (“Contest”) is open to Professionals and Students who are English-speaking adults, who are the age of 18 years or older (or of the age of majority in jurisdictions where the age of majority is over 18 years and where such Contests are legal).
Professionals: Professionals are self-identified photographers who currently receive or have received payment for their photographs, and who are resident in a non-U.S.-embargoed country where such Contests are legal given the Rules as published. This promotion is not available in countries, states, or provinces where rules translation, registration, or bonding are required.
Students: Students are full-time and part-time undergraduate and graduate college students, 18 years of age or older, attending a two or four year accredited college or university, who are actively enrolled in that college or university through at least Spring semester 2011. Students who are currently enrolled, but are not taking courses for credit are not eligible. In the event of any question as to eligibility, Sponsor reserves the right — and Contestants hereby agree — to require Contestants to provide reasonable evidence of status.
Collectively, all entrants are “Contestants”.
The Contest is sponsored by Blurb, Inc. (“Blurb”) 580 California Street, Suite 300, San Francisco, CA 94104 ("Sponsor"). Sponsor’s employees and their immediate families, as well as affiliates and Sponsor’s associates who have participated in the administration of this promotion are not eligible to participate. The Contest is subject to these Official Rules. This Contest is void where prohibited or restricted by law, and is subject to applicable federal, state, provincial and local laws.
2. SUBMISSION GUIDELINES
Contest submissions (“Submissions”) must be photography books that are self-published either through the Blurb website or through other self-publishing means. IF SELF-PUBLISHED THROUGH BLURB, SUBMISSIONS MUST HAVE THE “FULL PREVIEW” OPTION TURNED ON FOR THE DURATION OF THE CONTEST. Submissions may not be published by any third party publisher. The Submissions must be original works of authorship, entered by the author who holds all rights to the Submission. Submissions made by multiple authors are presumed to be authorized by all listed authors, and Sponsor will communicate only using the single email address identified in the Submission form. In the event a prize results, the prize will be awarded in the first name listed in the Submission. The Contest Submission Period begins on April 14, 2011 at 3:00 PM Pacific Daylight Time (PDT), and ends on July 14 at 3:00 PM PDT (the “Contest Submission Period”). ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST SUBMISSION PERIOD. By participating, contestants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Contest.
THERE ARE TWO WAYS TO ENTER
Submissions can be made online at www.photographybooknow.com by following the Contest link, completing the web entry form in its entirety and paying a Contest submission administration fee of your choice of $35 in US Dollars (“Submission Fee”), €27.50 Euros, £20 in Great Britain Pounds (GBP), $35 in Australian Dollars (AUD), $35 in Canadian Dollars (CAD). Credit card payments only (Sponsor accepts Visa, Mastercard, American Express and Discover). Contestants who choose to enter online must create their books using Blurb’s creative publishing platform. Online Submissions must be entered by 3:00 PM PDT on July 14, 2011 according to Sponsor’s time. No emailed Submissions will be accepted. Note that once your book has been uploaded to Blurb, you have a 15 day window within which a copy of the book must be purchased (by you or anyone else to whom you make it available). If a copy of the book is not purchased within 15 days, you’ll need to upload your book again as it will have been removed from the Blurb servers.
Hard Copy Entry:
If you do not wish to use the online method, which requires you to create a book using the Blurb creative publishing platform, you may enter a book via the post in the following manner: Download the entry form available here. Send the completed entry form and payment information as required on the form, as well as one (1) physical copy of each book entered, to: “Photography Book Now International Juried Competition,” 580 California Street, Suite 300, San Francisco, CA 94104. Hard-copy Submissions must be self-published books. Hard-copy Submission entry forms are available for download at www.photographybooknow.com. Hard-copy Submissions must be postmarked by July 14, 2011 and received no later than July 18, 2011. No hand-delivered Submissions will be accepted. Hard copy Submissions are not eligible for People’s Choice Awards.
There is no limit to the number of Submissions that any Contestant can make in any category; however, each Submission (online or hard-copy) must be made using a separate entry form and include a separate Submission Fee. Once entered, all Submissions are final; no changes or edits may be made. If a Submission is purposely or unintentionally deleted once uploaded, that Submission will not be eligible for judging and no refund will be issued, regardless of the reason. One Submission may not be substituted for one that has already been entered. No refunds for any reason.
No incomplete Submission, including Submissions without the required Submission Fee, will be processed. Contestant may not be notified that its Submission is incomplete. Sponsor retains the right to refuse any Submission for any reason.
All Submissions become the sole property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, unintelligible, or postage-due submissions and those Submissions are void and will not be accepted; nor is Sponsor responsible for any problems, bugs or malfunctions Contestants may encounter when seeking to enter their Submissions. Only complete valid entries will be accepted.
In making a Submission, Contestants must enter the Submission in one of four categories: (1) Fine Art, (2) Documentary, (3) Travel, or (4) Student.
Neither Sponsor nor the Contest Judging Panel will switch a Contestant’s Submission into a different category at the request of a Contestant once entered. Judges who deem a Submission is entered into an incorrect category, may move a Submission to a different category with Contestant’s approval, if the Judges believe such Submission has a better chance of winning in a more appropriate Category. In the event Contestant does not provide his/her approval, Submission will remain in Contestant’s selected category. The removal of a Submission from one Category to another is not a guarantee that an entry will win a prize. If no Category is selected during Submission, judges will select the most appropriate category.
Judging for prizes will be conducted by a panel of qualified judges. There will also be a People’s Choice round of judging, as outlined below. Note that mail-in books will not be eligible for the People’s Choice award, as all People’s Choice judging will be conducted online.
Judging will be completed in two (2) rounds. All entries will be prescreened to insure the entries have correctly met the Submission Guidelines and meet with Sponsor’s general standards and practices prior to any judging (“Qualified Submissions”).
At any time before, during or after the Contest Period, Sponsor may, in its discretion, choose to post or distribute one (1) or more Submissions, their creator’s name and profile information in any media and on any website (including on Sponsor’s website, You Tube, Flickr or Facebook page(s) and third-party websites) for promotional purposes only. Contestants understand that users of these sites may share, comment on (including negatively) and re-post their Submissions during and after the Voting Period. Posting of this/these Submission(s) will not mean that said Submissions are eligible to win or are a Finalist or Selected Contestant.
Round One: On or about July 19, 2011 the Qualified Submissions in each category will be reviewed and scored by a panel of qualified judges according to the following criteria with each criterion receiving equal weight:
- Cover design
- Strength of the photography
- Subject matter of the book
- Page layouts
- Editing and sequencing
- Emotional impact of the overall book
From this first round of judging, up to 200 Finalists (“Finalists”) in each category will be selected, using the criteria set forth above for the Final Judging Round. Any Finalist that entered a digital Submission will also proceed to the People’s Choice Online Voting Round, as outlined below.
Final Judging Round: Using the same criteria from Round One, the Finalists will be Judged and winners will be selected from among the highest scores (tying Submissions will be rescored). One (1) Selected Contestant for the Grand Prize will be selected from among the Finalists, regardless of in which Category Contestant designates their Submission. The one (1) Submission with the highest score overall of all of Contestant Submissions will be deemed the “Selected Grand Prize Contestant.” Each of the four Categories will have one (1) Category Selected Contestant, one (1) 1st Runner Up, one (1) 2nd Runner Up, and ten (10) Honorable Mentions in each Category (collectively “Selected Contestant(s)”). Selected Contestants will be announced publicly on or about August 29, 2011
People’s Choice Award
One Round of Online Voting: Any Finalist from Round One who entered a digital Submission shall be eligible to be considered for the People’s Choice Award. Finalists will be posted online at photographybooknow.blurb.com/voting, and people with a Blurb account will be allowed to vote for their favorite Submission. Online voting will be conducted for a two-week period and requires a Blurb.com account with a valid email address. Each account may only vote one time. Voters will not be able to change their selection once it has been submitted. At the end of the two-week voting period, winners will be announced. Use of bots, devices and other programs to increase views or votes is prohibited.
Sponsor may display electronic Submissions on its website for public view and public voting, and may announce a “People’s Choice Award” based upon the entry in each category that receives the most positive feedback. Hard Copy Submissions will not be eligible for the People’s Choice Award. The outcome of the People’s Choice Award has no bearing on the outcome of the professional judging round.
If eligible under these Rules, the Selected Contestants will receive:
One (1) US$25,000 cash prize made payable to the Contestant whose name appeared in the original entry form (Approximate Retail Value (“ARV”): US$25,000).
Four (4) US$5,000 cash prize made payable to the Contestant in each category whose name appeared in the original entry form (ARV: US $5,000 each)
1st Runners Up Prizes:
Four (4) 1st Runners Up will receive a “Gold Package”. (ARV: US$3,479 each).
2nd Runners Up Prizes:
Four (4) 2nd Runners Up will receive a “Silver Package”. (ARV: US$2,238.95 each).
People’s Choice Prize(s):
Four (4) US$1,500 cash prize made payable to the Contestant in each category whose name appeared in the original entry form (ARV: US $1,500 each)
Total ARV of Prizes: seventy-three thousand eight hundred seventy-one dollars and eighty cents (US $73,871.80).
For all prizes, all federal, state and local taxes and other expenses in connection with the prize are the sole responsibility of the Selected Contestant. All activities related to the prize are at the Selected Contestants’ own risk and subject to whatever restrictions are imposed by the entities that govern activities. Selected Contestants not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Prize may be awarded in the form of voucher(s), coupon(s) and/or gift card(s) in Sponsor’s sole discretion. Selected Contestants are solely responsible for any other unspecified expenses related to the Prizes, including shipping/handling, and any and all federal, state, and local taxes on prizes. If Selected Contestant is unable to participate in or accept the prize or any portion of the prize for any reason, Sponsor shall have no further obligation to the Contestant. Prizes will be awarded by U.S. mail or international carrier, in Sponsor’s discretion. Sponsor is not responsible for lost or damaged prizes.
6. USE OF SUBMISSIONS
Copyright and all other rights remain those of Contestant and/or any third parties from whom Contestant has obtained permission to use the third party’s material(s). Any book or image of the book used by Sponsor shall carry the photographer’s credit line. Use may include publication in any Blurb publication or web site. All Contestants understand and agree that any Submission may be used by Sponsor for marketing and promotional purposes including in any media such as exhibitions, print and digital media. All winning Contestants understand that their name, likeness and winning Submission will be used for marketing and promotional purposes including in any media such as publicity, exhibitions, print and digital media.
Sponsor reserves the right, but not the obligation, to display and distribute the Submissions for promotional purposes. By entering this Promotion, you grant the Sponsor a royalty-free, world-wide, fully paid-up, perpetual, irrevocable, non-exclusive right and license to use, reproduce, distribute, modify, adapt, and publicly display your submission; and to make derivative works of the Submissions, or edit Submission for practical and cost considerations, for use as display models in trade shows and exhibitions, and for promotional purposes.
7. WINNERS NOTIFICATION
Selected Contestants will be notified by phone or email, at the Sponsor’s discretion, using the information provided in the submission form. Selected Contestants will be required to respond (as directed) to the phone and/or e-mail notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, Sponsor may choose the next highest scoring Submission from among the remaining eligible submissions.
The Selected Contestants will also be sent an affidavit of eligibility / liability / publicity release (“Release”). Unless restricted by law, each Selected Contestant will be required to complete and return the Release within the time period specified therein. Should a Selected Contestant be unwilling or otherwise unable to provide such permissions and or releases or otherwise cannot accept or receive the prize for any reason, a Contestant with the next highest score will be chosen from the remaining entries until one who is able to meet all requirements can be selected as the Grand Prize Winner and for placement in each Category as described above. Each Selected Contestant’s full name, hometown and Submission will be announced to the public on or around August 29, 2011 and may be posted on Sponsor’s website and in other promotional media.
8. CONDITIONS; LIMITATION OF LIABILITY
By participating, contestants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, Selected Contestants agree to release Sponsor, its parent, subsidiary and affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest, (collectively, the “Releasees”) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Sponsor shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 200 entries, or due to circumstances beyond its control, including natural disasters. Submissions may be destroyed. Sponsor may prohibit a Contestant from participating in the Contest or winning a prize if, in its sole discretion, it determines such contestant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsor representatives. Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the State of California. Sponsor shall not investigate copyright ownership, which is the sole and exclusive responsibility of Contestant. In the event of a dispute arising out of ownership of copyright prior to awarding prize, and complaining party has properly complied with the Digital Millennium Copyright Act procedures, located at http://www.blurb.com/about/copyright, Submission will be removed from consideration. In the event of a dispute arising out of ownership of copyright after the awarding of the prize, Sponsor is not responsible for payment of award to any other party and prize recipient specifically indemnifies Sponsor from any and all liability associated with any third party claims. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit a contestant from participating in the Contest or winning prize if, in its sole discretion, it determines such contestant is attempting to undermine the legitimate operation of the Contest in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Except where prohibited by law, by accepting a prize, Selected Contestant agrees that Sponsor and its affiliated companies may use the Selected Contestant’s name, address, Blurb profile, photograph, and/or likeness for advertising, publicity and promotional purposes without limitation or additional compensation.
